Terms of service
These terms apply to the use of Usecue POS at pos.usecue.com, both the point of sale and the payment page. Usecue POS is operated by Usecue BV in the Netherlands. By creating an account you accept these terms.
The service
Usecue POS is a cash register and payment page that runs in your browser. It generates QR codes and payment links that point to your own bank account or to a payment link provider of your choice. Usecue POS is not a payment service provider: we do not hold, receive or transfer money. Payments go directly from the buyer to you.
Your account
You provide accurate information and keep your login details secure. You are responsible for everything that happens under your account, including the actions of users you add. The service is intended for business use and you must be entitled to act on behalf of the company you register.
Your responsibilities
You make sure that your company name, IBAN and other profile data are correct. You are responsible for your products, prices, VAT, receipts and all other legal obligations towards your buyers. You use the service only for lawful purposes.
Payment status
The application marks a sale as paid based on the confirmation of the buyer or on data from your bank connection. A status in the application is not proof of payment. Only your bank statement is. You check your bank account and you carry the risk of unpaid, reversed or fraudulent payments.
Third-party services
Payment links (such as Tikkie), the Ponto bank connection and Google sign-in are services of third parties. Their terms and fees apply. We may add or remove supported payment link types at any time.
Price
Usecue POS is currently free of charge. If we introduce paid features we will inform you at least 30 days in advance. You can stop using the service at any time.
Availability
We aim for high availability but do not guarantee it. The service may be unavailable during maintenance or due to circumstances beyond our control. We may change the service, and we may discontinue it with at least 30 days’ notice, during which you can export your data.
Acceptable use
You do not use the service to commit fraud, to sell illegal goods or services, to send unsolicited email or to disrupt the service or its users. We may suspend or terminate accounts that violate these terms.
Intellectual property and data
The software remains the property of Usecue BV. The data you enter remains yours. You grant us the right to process it for the sole purpose of providing the service. How we handle personal data is described in our privacy policy.
Liability
The service is provided as is. To the extent permitted by law we are not liable for indirect damage, lost revenue, lost data or damage caused by third-party services, unpaid payments or the unavailability of the service. Our total liability is limited to the amount you paid us in the twelve months before the event that caused the damage. Nothing in these terms excludes liability for intent or gross negligence.
Termination
You can stop using the service at any time and ask us to delete your account. We may terminate your account if you violate these terms, or for any other reason with 30 days’ notice.
Changes
We may change these terms. The current version is always available on this page and we announce material changes on the website. Continued use after a change means you accept the new terms.
Governing law
Dutch law applies to these terms. Disputes are submitted to the competent court in the Netherlands.
